PERSONAL DATA PROTECTION GENERAL INFORMATION AND DISCLOSURE STATEMENT

This Disclosure Statement has been prepared by HERA CHARGE ELEKTRONIK, with MERSIS Number: 0461 1117 5740 0001 (referred to as the “COMPANY” or “HERA CHARGE”), in its capacity as the “DATA CONTROLLER” pursuant to Article 10 of the Turkish Personal Data Protection Law No. 6698 (“PDPL”) and the Communiqué on the Procedures and Principles for Fulfilling the Obligation to Inform. “HERA CHARGE” assures that personal data provided to it are not used for purposes other than those intended, are not processed without explicit consent or any of the exceptions under Article 5 of the PDPL, and are not shared with third parties. Additionally, appropriate administrative and technical measures are taken to ensure the necessary level of security.

1. What Personal Data Is Processed and For What Purposes Are Your Personal Data Processed Within the Scope of Our Activities?

1.1. For Individuals Applying for Employment:

  • Identity Information: (Name/Surname, T.R. identity number, Date/Place of Birth, Marital Status, Nationality, ID Card/Driver’s License),

  • Professional Experience Information: (Performance data obtained from talent tests during interviews, courses attended, seminars, certifications, previous employment),
  • Physical Space Security Information: (Images recorded by camera footage),
  • Visual and Audio Records: (Photo attached to the application form/CV submitted via job search platforms),
  • Legal Transaction Information: (Information containing personal data in correspondence with judicial authorities or legal documents during a judicial process),
  • Health Data/Special Category Data: (Health data provided voluntarily by the individual),
  • Other: (Driver’s License Information, Military Status obtained via e-Government, Computer Proficiency Level, Programs used, SGK Employment Notification, Smoking habit, signature, handwriting)

1.2. For Employees:

  • Identity Information: (Name/Surname, T.R. identity number, Date/Place of Birth, Marital Status, Nationality, ID/Driver’s License/Passport Copy, Family Record Certificate),

1.3. For Customers:

  • Identity Information: (Authorized Representative of Real/Legal Person or Individual Customer Name, surname, T.R. identity number),

  • Financial Information: (Tax ID number, bank account/IBAN, invoice details),
  • Physical Space Security Information: (Images recorded by camera footage),

  • Family Member Identity and Contact Information: (Parent’s name, phone number, or in the absence of a guardian, the name, contact details, and signature of a close relative),
  • School Information: (School name, department, student number, employment start date),

Legal Transaction Information (Information containing personal data included in correspondence with judicial authorities and in case of a potential legal process, data included in petition and response letters provided to the courts),

  • Other: (School administrator’s name and surname, signature information),
  • Health Data: (Health data transmitted with the individual’s own consent)

We collect and process these categories of data for the purposes of managing Emergency Response Procedures, conducting Information Security Processes, fulfilling Employment Contract and Legal Obligations for Employees, Organizing and Monitoring Employment Relations, carrying out Activities in Compliance with Legislation, managing Finance and Accounting Procedures, ensuring Loyalty Processes related to Firm/Product/Services, ensuring Physical Space Security, following and managing Legal Processes, conducting Legal/Technical and Administrative Resulting Activities, conducting Internal Audit/Investigation/Intelligence Activities, managing and monitoring Communication Activities, conducting Recruitment Policies and Employment and Personnel Management as part of Human Resources Operations Management, managing and monitoring Business Activities, conducting Occupational Health and Safety Activities, collecting and evaluating Suggestions for Improvement of Business Processes, ensuring Business Continuity Activities, conducting After-Sales Support Services of Goods/Services, managing Sales Processes of Goods/Services, conducting Goods/Services Production and Operation Processes, managing Customer Relationship Processes, conducting Customer Satisfaction Activities, managing Organization and Event Processes, conducting Marketing Analysis Activities, carrying out Advertising/Campaign/Promotion Processes, conducting Risk Management Processes, conducting Retention and Archiving Activities, managing Insurance Processes, carrying out Contract Processes, tracking Requests/Complaints, conducting Promotional Activities, ensuring Payment of Salaries, managing Marketing Processes of Products/Services, ensuring the Security of Data Controller Operations, providing Information to Authorized Persons/Institutions and Organizations, managing Management Activities, and creating and monitoring Visitor Logs.

To Whom and For What Purpose Personal Data May Be Transferred The personal data categorized and processing purposes stated above may be transferred, limited to the conduct of business activities, domestically and abroad; to your authorized attorneys and representatives (to fulfill business activities and responsibilities arising from the law, to fulfill our legal obligations), to Authorized public institutions and organizations (to fulfill our obligation of proof in a possible legal process, to fulfill our obligations arising from laws and other legal regulations), to Lawyers, Consultants, Banks, Financial Advisors, Occupational Safety and Health (OSGB/ISG) Firms, Insurance Consulting/Agencies, and Other Private Law Legal Entities (to fulfill business activities and policies and to fulfill responsibilities arising from the law), to domestic and foreign-based storage, archiving, IT support establishments (R&D, PDKS, server, hosting, software, cloud, IT) and to persons referenced by you (for confirmation purposes).

3. Method and Legal Basis for Collecting Your Personal Data Your personal data, for the purposes listed above, is collected by “HERA CHARGE” through forms filled out during contract procedures, based on the information and documents you provide to the data controller, through automatic or non-automatic means, in written, verbal, or electronic formats. Your personal data is collected based on the legal grounds specified in Articles 5 and 6 of the Law, the establishment or performance of a contract, the legitimate interests of “HERA CHARGE” and its legal obligations, the establishment, use, or protection of a right, and if necessary, the explicit consent of the individual.

4. Your Rights as a Personal Data Owner Under Article 11 of the Law As a personal data owner, under Article 11 of the Law, you are entitled to request to know if your personal data is processed, request information if your data has been processed, know the purpose of processing your data and whether it is used in accordance with its purpose, know the third parties to whom your personal data is transferred domestically, request correction of your personal data if it is incomplete or incorrectly processed and request the notification of this correction to third parties to whom your data has been transferred, request the deletion or destruction of your personal data if the reasons for processing are no longer valid even though it has been processed in accordance with the Law and other relevant laws, and request notification of this process to third parties to whom your data has been transferred, object to any adverse outcome resulting from the exclusive processing of data through automated systems, and request compensation if you suffer damage due to unlawful processing of your personal data.

You can submit your applications regarding your rights listed in Article 11 of the PDPL by filling out the Relevant Person Application Form available on our website www.heracharge.com or by submitting another written document with similar content to “HERA CHARGE”. Depending on the nature of your request, your applications will be processed free of charge within the shortest possible time and no later than thirty days; however, if the transaction requires an additional cost, a fee may be charged based on the tariff set by the Personal Data Protection Board. PERSONAL DATA PROTECTION CCTV RECORDS DISCLOSURE AND INFORMATION NOTICE

This Disclosure Notice has been prepared by HERA CHARGE ELEKTRONik A.Ş. (“COMPANY” or “HERA CHARGE”) in its capacity as the data controller, in accordance with Article 10 of Law No. 6698 on the Protection of Personal Data (“PDPL”) and the Communiqué on the Principles and Procedures for Fulfilling the Obligation of Disclosure.

CCTV recordings are taken at the entrance doors, building exterior, cafeteria, production/working areas, warehouse, and office floors within our service buildings via security cameras to ensure the security of the building/workplace. These recordings are monitored by the secretary and supervised by the General Manager, the Financial and Administrative Affairs Manager, and the relevant department manager.

The legal basis for processing these personal data is derived from Article 5 of the Law on the Protection of Personal Data No. 6698, based on the necessity of processing for the data controller’s compliance with legal obligations and the necessity of processing for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject. The personal data in question may be transferred to judicial authorities or law enforcement agencies upon request to resolve legal disputes or as required by relevant legislation.

As a personal data owner, pursuant to Article 11 of the Personal Data Protection Law No. 6698, you have the following rights:

  • To learn whether your personal data is being processed,
  • To request information if your personal data has been processed,
  • To learn the purpose of processing your personal data and whether it is being used in line with that purpose,
  • To know the third parties in the country to whom your personal data has been transferred,
  • To request the correction of incomplete or incorrect personal data and to request that the third parties to whom your personal data has been transferred are notified of this correction,
  • To request the deletion or destruction of your personal data if the reasons for processing them no longer exist, even if they have been processed in accordance with the law, and to request that the third parties to whom your personal data has been transferred are notified of this action,
  • To object to a result arising against you if your personal data has been exclusively processed through automated systems,
  • To claim compensation for damages in case you suffer damage due to the unlawful processing of your personal data.

You can submit your requests regarding your rights listed above in Article 11 of the PDPL by filling out the Data Subject Application Form available on our website www.heracharge.com or by submitting a written document of similar content to “HERA CHARGE.” Your application will be processed free of charge and resolved as soon as possible and at the latest within thirty days, depending on the nature of your request; however, if the process incurs an additional cost, a fee may be charged according to the tariff determined by the Personal Data Protection Board.
